These Terms of Service form a binding agreement between you and Guess X. By creating a Guess X account, signing in, or otherwise using the Guess X mobile application or website (collectively, the "Service"), you agree to be bound by these Terms and by the Guess X Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old, or the higher minimum age set by the law of your country of residence, to use Guess X. Where Apple's App Store or Google Play sets a higher age rating for the app in your region, that age rating applies. If you are a minor under the law of your jurisdiction, you must have permission from your parent or legal guardian to use the Service and to make any in-app purchases.

You may create a Guess X account using your email and password, with Sign in with Google, or with Sign in with Apple. You agree to provide accurate registration information, to keep your password and authentication credentials confidential, to verify your email when prompted, and to use the in-app password-reset flow if you forget your password. You are responsible for all activity that occurs on your account. You must notify support immediately if you suspect unauthorized access. Repeated failed login attempts may trigger a temporary lockout for security reasons.

Subject to your compliance with these Terms, Guess X grants you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the Guess X mobile application on a device that you own or control, and to use the Guess X website, solely for your personal, non-commercial entertainment. All rights not expressly granted are reserved.

When you use Guess X you agree not to: (a) cheat, use third-party scripts, bots, macros, modified clients, or any form of automation to gain a competitive advantage; (b) exploit bugs, network manipulation, or game-system vulnerabilities; (c) sell, transfer, share, or trade Guess X accounts, Tokens, or in-game items outside the Service; (d) use the reaction system or any other input to harass, threaten, defame, or harm other players; (e) impersonate any person or use a display name that is offensive, obscene, deceptive, hateful, or that infringes the rights of others; (f) reverse engineer, decompile, or attempt to extract source code from the app except where permitted by law; (g) interfere with or overload the Service or its infrastructure; or (h) use the Service in violation of any applicable law, regulation, or the rules of Apple's App Store or Google Play.

Guess X operates competitive systems including ranked play, seasons, leaderboards, and leaderboard rewards. Rank points, leaderboard positions, and reward eligibility are calculated by the Service. To protect competitive integrity, we may correct, recalculate, or roll back rank points, leaderboard positions, payouts, or other competitive state when we detect cheating, exploitation, bugs, or other violations of these Terms.

Guess X uses an in-game virtual currency called Tokens, together with daily missions, achievements, win streaks, rewarded ads, and competitive payouts. Tokens, daily missions, streaks, achievements, profile characters, reactions, and any other virtual item are licensed to you for personal use inside Guess X. They are not your property, have no monetary value, are non-transferable between accounts, are non-refundable from Guess X, and cannot be exchanged for cash or any thing of real-world value. We may adjust the cost, availability, or balance of these items, end an event or season, retire items, or modify mission, streak, and reward systems at any time to keep the game balanced, fair, secure, and compliant. Tokens and other virtual items associated with a deleted, suspended, or terminated account are forfeited.

All purchases of Token packages and any other paid items in Guess X are processed exclusively by Apple App Store In-App Purchase on iOS and Google Play Billing on Android, using the product identifiers we configure for each item. The price you pay, taxes, and your eligibility for refunds are governed by Apple's or Google's store terms. Refund requests must be submitted to Apple or Google through their official refund processes; Guess X cannot issue refunds for App Store or Google Play purchases. Once the platform confirms your purchase, we credit the corresponding Tokens or items to your account. If your purchase is reversed or refunded by the platform, the corresponding Tokens or items may be removed from your account.

Guess X may offer optional rewarded ads as a way to earn Tokens. Watching a rewarded ad is your choice. Rewarded ads have a daily limit per account and may be unavailable in some regions, on some platforms, or when no eligible ad is served. Ads displayed inside Guess X are subject to the rules of the ad partner that serves them, and you remain in control of platform-level ad settings on your device.

Guess X allows you to choose a display name, country, profile character, and to send predefined in-game reactions during matches, and to submit text content through the support, feedback, and abuse-report forms. By submitting this content, you grant Guess X a worldwide, royalty-free, non-exclusive license to host, display, process, and use it for the purpose of operating, moderating, and improving the Service and investigating reports. You are responsible for the content you submit. You must not submit content that is unlawful, harassing, defamatory, sexually explicit, hateful, deceptive, infringing on third-party rights, or that violates these Terms. We may remove or change any submitted content, including display names and avatars, at our discretion.

We provide in-app tools for reporting players, matches, messages, and content. We review reports and apply enforcement actions consistent with these Terms and our internal policies. Enforcement actions may include warning a player, removing or replacing display names or avatars, restricting access to specific features (for example reactions, matchmaking, or rewarded ads), temporarily suspending an account, blocking the account, or, in serious cases, permanent termination. Enforcement decisions are based on the information available at the time and may be reviewed on appeal through support.

Your use of Guess X is also subject to the terms of the platform you use to access it. On iOS this includes Apple's App Store Terms of Service, the Apple Media Services Terms, the Apple developer end-user license terms, and the standard EULA imposed by Apple on app downloads. On Android this includes the Google Play Terms of Service. Apple and Google are not parties to these Terms and are not responsible for Guess X or for any claim relating to Guess X. To the maximum extent permitted by law, you acknowledge that Apple and Google are third-party beneficiaries of these Terms only to the extent required by their respective platform rules, and that we, not Apple or Google, are responsible for the Service and its content (subject to the limitations of liability in these Terms).

All intellectual-property rights in Guess X — including the app, the website, the clue packs, the game design, the categories, characters, artwork, reaction emotes and animations, the brand name, logos, and all underlying software — are owned by Guess X or its licensors and are protected by applicable laws. The license granted in Section 4 does not transfer any ownership to you. You must not copy, distribute, publicly display, modify, or create derivative works of the Service except as expressly permitted by these Terms or applicable law.

Guess X may add, modify, or remove features, content, categories, or seasons; perform maintenance; throttle, restrict, or temporarily suspend the Service; or stop offering the Service in a region — at any time and, where reasonable, with notice. The Service is not guaranteed to be available without interruption.

We may suspend, restrict, or terminate your access to the Service, in whole or in part, if you violate these Terms, if your account presents a security or anti-fraud risk, if required by law, or if continued service is not commercially viable. You may stop using Guess X at any time by uninstalling the app, and you may delete your account through the in-app deletion flow described in our Privacy Policy and the Account Deletion page. Provisions of these Terms that by their nature should survive termination — including those regarding intellectual property, virtual items, disclaimers, limitation of liability, and dispute resolution — will continue to apply after termination.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Guess X disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that the Service will meet your specific expectations or that any defect will be corrected.

To the maximum extent permitted by law, Guess X, its affiliates, officers, directors, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, data, virtual currency, or Tokens, arising out of or related to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total cumulative liability arising out of or related to the Service will not exceed the greater of (a) the total amount you paid to Guess X through Apple App Store or Google Play in the twelve months preceding the event giving rise to the claim, or (b) the equivalent of twenty United States dollars. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

To the maximum extent permitted by law, you agree to indemnify and hold harmless Guess X and its affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of (a) your use of the Service, (b) your violation of these Terms or any applicable law, or (c) your infringement of any right of any third party.

These Terms and any dispute arising out of or related to them or the Service will be governed by the laws applicable at the principal place of business of Guess X, without regard to its conflict-of-law rules, except where mandatory consumer-protection law in your country of residence applies. Nothing in this Section limits any non-waivable consumer rights you have under your local law.

We may update these Terms from time to time. When we make material changes we will update the version number and the last-updated date shown with these Terms, and where appropriate we will notify you in-app. Your continued use of Guess X after updated Terms take effect constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the Service and may delete your account.
